Three most common types of personal injury claims

    By Artur Polianskyi7th June 2022

It can be traumatic when you’ve suffered an accident. And that’s before you even consider frustration and difficulties during recovery. If you’ve been in an accident that wasn’t your fault, then it might be a good idea to contact a personal injury solicitor to help you try and win the compensation you deserve. Below, we explore three common situations that can lead to a personal injury claim.

    Car accident claims

Car accident claims are among the most popular forms of personal injury claims. This is partially because of the wealth of evidence that you can summon having been in a motor accident. Many drives have dashcams available, there are plenty of witnesses on the roads and there’s security footage too. Nevertheless, the number of claims fell from 446,976 in 2020/21 to 387,687 in 2021/22. If you’ve been in a car accident, it’s worth quickly gathering evidence and assessing your injuries in case you decide to make a claim.

    Claims against an employer

Claims against an employer usually refer to accidents happening inside the workplace. This is usually if the workplace was inherently unsafe, or if someone at work was at fault for your accident. In this situation, you should make a personal injury claim and also record the accident in your workplace’s accident book. Claims against an employer are one of the most common forms of personal injury claim, but they’ve also fallen recently. From 2020 to 2021, there were 45,687 claims against an employer, compared to 43,769 from 2021 to 2022.

    Clinical negligence

Clinical negligence claims refer to accidents that happen in a medical setting. This will be when a medical professional falls below their duty of care towards you and that you suffered as a result. Failure could mean a misdiagnosis, a mistake in surgery, prescription errors or pregnancy and birth injuries amongst other problems. In these types of cases, you have to prove that a professional fell below expected standards. These claims have risen recently: there were 14,485 claims from 2020 to 2021, compared to 15,549 in the last year.

Making a personal injury claim can help you win the compensation you deserve to focus on your recovery. Whether you’re making a clinical negligence claim, a motor accident claim or a claim against an employer, by working with experienced solicitors you can boost your chances of success.
